HOME BLDR is a mobile application designed to help homeowners and builders document and track the construction process of residential properties. The App provides features including:

• Photo documentation and organization
• Construction progress tracking
• Project timeline management
• Note-taking and annotation tools

3. User Accounts

To use certain features of the App, you may be required to create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Be responsible for all activities under your account

4. User Content

You retain ownership of all photos, notes, and other content you upload to the App. By using the App, you grant us:

• A license to store and display your content as necessary to provide the service
• The right to use your content for technical operations (backup, restoration, etc.)

You are solely responsible for your content and must ensure you have all necessary rights and permissions.

5. Prohibited Uses

You agree not to:

• Use the App for any unlawful purpose
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the App's functionality
• Upload malicious code or harmful content
• Harass, abuse, or harm other users
• Impersonate any person or entity

6. Subscription and Payments

Certain features may require a paid subscription. By subscribing, you agree to:

• Pay all applicable fees at the prices in effect when charges are incurred
• Automatic renewal unless you cancel before the renewal date
• Provide current and accurate payment information

Subscriptions are managed through the Apple App Store or Google Play Store and are subject to their terms.

7. Cancellation and Refunds

You may cancel your subscription at any time through your App Store or Google Play account settings. Refunds are handled according to Apple's and Google's respective refund policies.

8. Intellectual Property

The App, including its design, features, and content (excluding user content), is owned by HOME BLDR and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. We do not warrant that the App will be uninterrupted, error-free, or secure. Use of the App is at your own risk.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HOME BLDR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, OR OTHER INTANGIBLE LOSSES.

11. Indemnification

You agree to indemnify and hold harmless HOME BLDR from any claims, damages, losses, liabilities, and expenses arising from your use of the App or violation of these Terms.

12. Modifications to Service

We reserve the right to modify or discontinue the App at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the service.

13. Termination

We may terminate or suspend your account and access to the App immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the App will immediately cease.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which HOME BLDR operates, without regard to conflict of law provisions.

15. Dispute Resolution

Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration, except where prohibited by law. You waive any right to participate in class-action lawsuits.

16. Changes to Terms

We reserve the right to update these Terms at any time. We will notify you of any material changes by posting the new Terms on this page and updating the "Last Updated" date. Your continued use of the App after changes constitutes acceptance of the new Terms.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
